Dollshe and the sculptor may not advertise his products on this forum. Sales may not be discussed, no news threads may be posted regarding new releases. This ban does not impact any dolls by Dollshe ordered by November 8, 2023. Any dolls ordered after November 8, 2023, regardless of the date the sculpt was released, are banned from this forum as are any dolls released under his new or future companies including but not limited to Club Coco BJD. Artists Using Doll Likenesses without Crediting [Mijn Schatje discussion]

    1. Well, probably only a court can really wade through all the legalities of this, but I found a link to a site re: the Fairley case. There is a checklist from the copyright management office that can be used to determine if the item is an infringement of copyright. Here's the link.

    3. Chiburashka is very, very popular in Russia. But yes- checking the photographer's website, it does look very, very similar to the photo. Do we know what every came of this? It may be that Leeke and the photographer have come to some type of resolution and everyone is fine with it.

      ABOUT PHOTOBUCKET: I'm a little wigged out by the statement that basically gives anyone free reign with your work on photobucket. But if you make your albums private, can you still link the pictures to sites, blogs, etc?
      Frankly, I don't really like the idea of people rummaging around in my albums anyway. When I signed up for it, I didn't realize people could do that. But still- the whole reason I have it is for a source for linking stuff to website, forums, blogs, etc.
      Anyone know the answer about the private album thing?

    4. I keep my PB account private - meaning I can still link pictures that anyone can see, but they cannot access my PB album page and go through everything. So people only see what I link, where I link it. You can change the preferences in account settings, there's also a password option which allows certain people to see your album by entering a password you set.

      So I guess if Ms. Schatje had stolen some of your pictures from photobucket, it would be perfectly legal for her to use them?

    6. I'm not sure on that, but I HAVE had people steal graphics I made and put on PB before. They not only claimed they made them, but hotlinked them to their sites. I emailed PB and they suggested I replace the graphics with big red pictures that said "THIS PERSON STOLE FROM ME BLAH BLAH" which I did xD. Not helpful for this Mijn type situation, but for anyone else experiencing bandwidth theft.

      ALSO - There still isn't a dA news post on Mijn and there should be one. This is what I want someone to please do for me.

      Prepare a generic statement detailing the situation with a link to radiotrash's site. Just don't flame in any way or I will get a comment barrage like you wouldn't believe. I'd do it, but I have to take care of my mom like right now xD. So if someone would kindly volunteer and PM it to me, I will make a dA news post.
       
    7. Just to illustrate what people are talking about here, this isn't just a case of "LeeKe brought out a doll and stuck Mickey Mouse ears on it" (as has been suggested upthread):

      On the left, LeeKe Milch; on the right, the image by Russian photographer Oleg Dau that it's alleged Milch was based on. I believe that case still hasn't come to a resolution, which may well be why LeeKe are being somewhat meek over Schatje's plagiarism - they would look pretty hypocritical sounding off at her for plagiarism whilst being guilty of something similar themselves.
       
    8. The problem with that is it has nothing to do with DA really. Sure its art related, but she doesn't have an account there or anything so I don't know if that would be needed.
       
    9. That's not the point at all. With so many people on there that like art and follow artists, I think it's a great place to spread the news. All dA news is not just about deviantart, in fact most of it relates to outside general art news. The way I see it, if ONE person who liked her finds out the truth, then it's a success. For example, a close friend of mine did a news post about saving Snow Leopards - obviously totally not -dA related but it raised 3 grand.
       

    10. Sorry here but copying anything from any source to use as your own idea is wrong (w/o approval from the images/items owner/creator). Though I do agree with you about them not wanted to deal with "the Mijn mess".
       
    11. Oh dear. Just had my attention drawn to this Etsy seller. I rather doubt those are all he own dolls; anyone recognise them? I suspect a few are company images....:doh
       
    12. I recognise a few owner dolls and some Happydoll shop photos which are no longer online (convenient in their case.)

    16. Yep, there are official Volks photos. However, they really do not seem to be stating it as their own work and they do state that buyers can not sell the items made from the sheet. It really is different from the Mijn case imho, though still not really OK in my book.
       
    17. The seller says that the collage sheet cannot be resold; they say nothing about the products made from the images.

    19. Ah, I must have misunderstood what they meant..I thought they meant you can not make things and sell what you make from them...still pretty lame regardless.
       
    20. She's pulled the item after I pointed out the copyvio; hopefully she'll be a little more careful in future. I think language was an issue in her case; aenota (said seller) is from the Ukraine and her reply to me was rather "Engrished".

      All this kerfuffle has brought about one good little thing though - Tanya, the Etsy seller who was doing digital collage cards, has now decided to get herself a Bobobie Mei and has been reading up on BJDs. :)
